Super Mario Bros Crossover Legality

Now, I am not a lawyer and this sure ain't legal advise. But at a certain point you really have to wonder. The game Super Mario Crossover uses illegal assets and the owner Jay Pavlina seems to be no literally bragging that he makes money from the game. It even seems that the revenue from Super Mario Crossover supports him so he doesn't have to work a job like normal people.

It looks like a Kickstarter backer, Dag Härdfeldt, has even let Nintendo know about this.

Honestly, if Nintendo knows about Super Mario Crossover and that Jay Pavlina makes money from it and it has not received a cease and desist, it is almost like Nintendo has said, sure its ok, go ahead and use our assets and profit from them. We'll see what happens I guess.

Though how would Nintendo even contact Jay? He hides behind a "contact form" on his site with no email address.....

  3. Are you aware that "Super Mario Bros. Crossover 2" and "Super Mario Bros. Crossover 3" are not real things? It's all the same thing, just different versions.

  5. You should know smbc is not illegal, they are not making money off of it, they are making money off of advertisements on the site. There is a big difference, and the reason people don't often throw their email out for the world to see is because they are personal and nobody likes spam, contact forms work just as well as email the use of them is much like the use of an alt email account so that business stays separate from personal use. You say smbc is a scam but what proof do you have, you've made generalized statements but haven't said anything that can't be easily disputed with the FAQ provided for SAS/SRS.

  7. Why does the creator of this blog site hide behind Anonymity? If I were trying to call someone on their bullshit, I would put my name all over it solely can have at least a fair and balanced discussion. Since it is being remarked that Jay hides, but yet I do not see the creator of this site's information in the profile.

    Haters gotta hate because they didn't think of it first I guess. I rather am glad and hope Nintendo doesn't ever stop Super Mario Crossover. I have wanted a game like that since the days of the first NES, it's a dream game and I'm glad I didn't have to write it, so why not support a little to someone that DID take the time and the patience to do so.

    Let him try to start a career, he isn't doing anything different from what other businesses do starting out, and yeah he does have a self imposed job, making games! Like the creators of Nintendo and Sega and everyone else before him.

    How long will it take for this post to disappear because I disagree? People are no longer entitled to opinions if it doesn't support what is being said it seems, so lets see how hypocritical the OP is.

  8. Also, if you are going to go after one person using "Abandonware" to make money off of, you better start going after everyone else.

    www.vizzed.com is a web site dedicated to allowing you to play all sorts of "remade" or "hacked" games. I love it, but they claim to own these games and if anything, they seem to be going balls to the walls with what is being blamed on Jay.

    Besides, Nintendo already knows Super Mario Crossover exists.

  10. First rule to create fame and glory for one's self is to steal from others. Moreover, the best way to do this is act like the ones that you are duping are already being duped and once you trick some of them, do the same thing but named as something else. Funny how the pot calls the kettle black, can't even own up to what you comment about with a name.

  11. Dudes, really? i think this webpage is just from a guy how was willing to pay 1000 from the kickstarter, and its more willing to pay for making a fucking website, anyways. Jay asked nintendo for his characters and putting ads and stuff, to impulse him up to make an original game, so, the guy that created this webpage just getted a rage from the game being cancelled, its the guys problem, posting fake things about jav and his webpage
